Terms and Conditions
1. Scope of application
The latest version of the Terms and Conditions shall apply to all agreements concluded between Raab Vitalfood GmbH and its customers. By completing their order, customers accept Raab Vitalfood GmbH’s Terms and Conditions. The Terms and Conditions can be downloaded and printed out anytime from the website.
All agreements pertaining to the online order are included in the purchase agreement and the order confirmation. There is no additional storage of the contractual text.
2. Agreement conclusion
All information provided in the online product catalogue is subject to change. By clicking on the “Buy now” button, the customer places a binding order of the goods contained in their shopping cart. Receipt of the order is confirmed via email. Only this email constitutes the conclusion of the purchase agreement. Ordering is limited to retail quantities.
3. Prices and payments
Prices relevant to an order are always those valid at the time the order was placed. Prices include VAT but do not include shipping. Raab Vitalfood GmbH reserves the right to dispute the purchase agreement if prices are quoted incorrectly due to a technical fault or error.
The following payment options are available:
- Advance payment: Customers are required to pay the invoice amount into Raab Vitalfood GmbH’s bank account within 7 days after a purchase agreement has been concluded. The order will be cancelled if this time limit is exceeded.
- SOFORT payment: This payment method requires personal PIN and TAN codes. Customers make the payment on a bank’s own website after being redirected. Purchases are shipped only after receipt of payment.
- PayPal: Customers make the payment via their own PayPal account, after which they are issued a confirmation via email. Purchases are shipped only after receipt of payment.
- Invoice: This payment method is only available after at least one order has been completed and only if the customer’s account is not in arrears.
- Credit card: The customer’s credit card is charged when they are issued their shipping confirmation.
Raab Vitalfood GmbH reserves the right to refuse any payment method at its own discretion.
If your payment is late, you are legally required to pay interest on arrears. Raab Vitalfood will charge a fee of €2.50 for each payment reminder.
Shipping to destinations in Germany is €3.60 per order under €30 and free of charge for orders above €30. Shipping fees for Austria and other EU countries are listed in the relevant chart. Shipping fees are only charged once if an order is split into more than one shipment.
Orders are shipped to the address provided by the customer. We reserve the right to charge customers for any expenses if the information provided by them is incorrect.
We do not guarantee deliveries on a certain day or within a certain amount of time. Raab Vitalfood GmbH reserves the right to split orders into partial shipments if not all products are in stock.
Customers are notified, if ordered products are out of stock, and provided with an expected delivery date. If an order cannot be fulfilled, Raab Vitalfood GmbH reserves the right to withdraw from the agreement and reimburse the customer for any payments made.
Customers outside of the EU are obliged to pay any applicable tariffs, customs or import duties. It is the customer’s sole responsibility to verify any imported products comply with the importing country’s national laws and regulations.
5. Retention of title
Any goods shall remain the property of Raab Vitalfood GmbH until the purchase price has been paid in full.
6. Warranty rights
The statutory warranty rights provided by the German Civil Code (§§ 433 ff. BGB) shall apply. No liability is accepted for naturally occurring spoilage of goods.
If the packaging or content of goods is noticeably damaged on receipt, the customer must, without any prejudice to their warranty rights, immediately file a complaint with the courier and notify Raab Vitalfood GmbH about the damage.
The liability for minor negligence shall be restricted to violations of material contractual obligations on whose fulfilment the customer may ordinarily rely and which are typically foreseeable.
8. Information obligation
In the event of any disagreement, you have the option to participate in a dispute settlement. The relevant form is available via the following link: http://ec.europa.eu/consumers/odr
9. Final provisions
Sole place of jurisdiction for all disputes shall be Ingolstadt. Should individual provisions of this agreement be ineffective or unenforceable, the effectiveness of the agreement is not otherwise affected thereby.
The ineffective or inexecutable provision is replaced by a valid clause that most closely corresponds to the effects of the economic purpose that the parties to the agreement had been planning to pursue.
All contracts and deliveries shall be governed by German law.
